2260.02 - FULL AND UNQUALIFIED LEGAL COMPLIANCE

The Board of Education is committed to providing appropriate educational services to all students. As such, the Board expects full and unqualified compliance with the legal rights of students of the Kirtland Local School District. The Board has zero tolerance for the infringement, violation and/or breach of any student’s legal rights under applicable state and federal legislation, including but not limited to the Family Educational Rights and Privacy Act, Individuals with Disabilities Educational Improvement Act, Section 504 of the Rehabilitation Act of 1973, and/or State and Federal nondiscrimination and civil rights laws.

The Board expects the educational and related programs of the District to be conducted in accordance with this policy at all times. The Board charges each administrator, professional staff member, and other employee with the responsibility to take all actions necessary to comply with this policy without exception or omission. In the event that an administrator, professional staff member or other employee has reason to believe that s/he is incapable of complying with this policy, such individual shall notify the Superintendent without delay of any duration or for any reason. If the Superintendent has reason to believe that s/he is incapable of complying with this policy, s/he shall notify the President of the Board without delay of any duration or for any reason. If an administrator, professional staff member or other employee has reason to believe that any other individual subject to this policy failed to comply with this policy’s obligations, s/he shall notify the Superintendent without delay of any duration or for any reason.

If an administrator, professional staff member or other employee fails to comply with the obligations of this policy, s/he shall be subject to disciplinary action up to and including the possibly of discharge.
