| | 1. | Employed retirees will be compensated at the discretion of the Board, and they will not be eligible for automatic salary increases (i.e. step increases). They will be eligible for raises received by other employees that are independent of step increases. They will not be eligible for longevity pay.

| | 2. | Employed professional staff retirees will not be eligible for continuing contracts but will be awarded one (1) year contracts, and those contracts automatically expire at the end of each school year without notice of nonrenewal. As a condition of employment, the employed retiree must expressly agree to knowingly and voluntarily waive his/her rights under R.C. 3319.11, 3319.111, and all other applicable laws, and to acknowledge that his/her rights to continued employment are different from the rights of other professional staff employees. This provision of the agreement and salary and contract cannot be grieved under GCESC procedures nor through any claim or action filed before the State Employment Relations Board (SERB) or any court of law. Performance evaluations may be conducted annually.

| | 3. | Employed retirees will not be eligible for retirement-incentive program nor are they eligible for severance pay. Employees who are rehired following retirement do not acquire seniority or recall rights in the event that his/her position is subject to a reduction in force (RIF).

| | 4. | Sick leave shall begin at zero (0) days for employed retirees unless they have accrued post-retirement sick leave elsewhere. Employed retirees shall earn one and one quarter (1-1/4) days of sick leave per month for the duration of their employment (unless there is a change in State Law in which case this number will change to match State Law.) Employed retirees will not be eligible for advance of sick leave.

| | 5. | The employed retiree must expressly agree and fully intend to the terms and conditions outlined above to supersede and take precedence over any inconsistent and/or contrary provisions of the Ohio Revised Code and Federal Law and Regulations.
